प्रतिलिपी अधिकार

प्रतिलिपी अधिकार एउटा कानूनी अवधारणा हो यसले कृतिकारलाई निश्चित समयका लागि त्यस कृति सम्बन्धि अधिकार प्रदान गर्दछ। खासमा यो कृतिको प्रतिलिपी बनाउने अधिकार हो तथापि यसले त्यस कृतिको आंशिक प्रयोग अथवा त्यसबाट लिइने लाभका लागि कृतिकारलाई श्रेय प्रदान गर्दछ। यो बौद्धिक सम्पत्ति (intellectual property)को रूपमा सर्वाधिकार ट्रेडमार्क अथवा ट्रेड गोपनीयता नामबाट सुरक्षित गर्न सकिन्छ।

इतिहास

The Statute of Anne came into force in 1710.

The British Statute of Anne (1710) further alluded to individual rights of the artist. It began, "Whereas Printers, Booksellers, and other Persons, have of late frequently taken the Liberty of Printing... Books, and other Writings, without the Consent of the Authors... to their very great Detriment, and too often to the Ruin of them and their Families:"

प्रतिलिपी अधिकार या कपीराइट बौद्धिक संपदाको एक रूप हो. जो एक मूल कृतिको लेखकको प्रकाशन, वितरण र अनुकूलनको निश्चित समय अवधिको लागि , विशेष अधिकार दिइन्छ।

प्रतिलिपी अधिकार या कपीराइट कुनै चीजको वर्णनमा छन्। यदि तपाईँं कुनै राम्रो कहानी लेख्नुहोस, या कुनै गाना संगीत-बद्ध गर्नुहोस, या पेन्टिंग करे त यो कुनै चीजको वर्णन हुनेछ| उनमा तपाईँंको प्रतिलिपी अधिकार हुनेछ| यदि उसलाई प्रकाशित गर्नुहोस त कुनै र उसलाई तपाईँंको अनुमतिको बिना प्रयोग नही गर्न सक्छ| नेपालमा प्रतिलिपी अधिकारको बारेमा प्रतिलिपी अधिकार ऐन कानून छ।

यहां प्रयुक्‍त कार्यहरूको अर्थ हो :-

साहित्यिक रचना :- यसमा कम्‍प्‍यूटर कार्यक्रम, सारणियां, संकलन बढी कम्‍प्‍यूटर डाटाबेस शामिल छन्।

नाट्य रचना :- यसमा गायन, नृत्‍य रचना या कुनै प्रदर्शनमा मनोरंजनको कुनै रूप, नाट्य प्रबंध या अभिनय जसको रूप लिखित या कुनै अन्‍य रूपमा तय हो, शामिल छन्।

संगीत रचना :- यसमा संगीत रचनाहरू शामिल छन्, यस्तो रचनाहरूको ग्राफीय रूप शामिल छ तर यसमा संगीत संग गाए, बोले या अभिनीत गरे जाने वाला शब्‍द या अंगविक्षेप शामिल छैनन्।

कलात्‍मक रचना :- यसको अर्थ छ चित्र, मूर्ति, आलेख (जसमा आरेख, मानचित्र, चार्ट या प्‍लान पनि शामिल है), उत्‍कीर्णन, या फोटोग्राफ, जति नै उनमा कलात्‍मक गुण हो या न हो। यसमा स्‍थापत्‍य रचनाहरू र कलात्‍मक कारीगरीको कुनै अन्‍य रचनाहरू पनि शामिल हुन सक्छं।

चलचित्र रचना :- यसको अर्थ छ कुनै यस्तो प्रक्रियामा जरिए, जसबाट कुनै पनि तरिका चलती-फिरती छवि निर्मित गर्न सकिन्छ, बनाए गए कुनै माध्‍यममा दृश्‍य रेकर्डिंगको कुनै रचना।

ध्‍वनि रेकर्डिंग :- यसको अर्थ छ ध्‍वनियोंको रेकर्डिंग जसबाट ध्‍वनियां निर्मित गर्न सकिन्छ, उन माध्‍यममा ध्‍यान दिए बिना, जसबाट ध्‍वनियां निर्मित गरिएको हो।

यहां 'सम्बन्धित अधिकार या निकटवर्ती अधिकार' छ कलाकारों (उदाहरणार्थ अभिनेताओं, गायकों र संगीतकारों), फोनोग्राम (ध्‍वनि रेकर्डिंग)को निर्माताहरू र प्रसारण संगठनहरूको अधिकार।
